Okay, so your court date is not as scary as you may think. Most of our cases are in downtown Detroit at 211 West Fort Street. Let's start with what you need so your case isn't adjourned and you have to go back to court. You must bring your driver's license, social security card, and any titles to vehicles. Parking is difficult and yes the Detroit ticketing authority does make lots of money issuing tickets. You can either park at a meter bring quarters or you can use the parking structure right accross from the court. It's expensive, but sometimes worth it. You can sometimes park at Cobo Hall on the roof, but lately it's been closed to public parking. One you enter the building you will want to get on to the elevator to the 3rd floor. Once you step out on to the third floor you will see a room where people are sitting and most attorneys are in suits. Once you get inside the room there are separate rooms where the hearings will take place. Typically they are labled A, B, C, D, etc... by Trustee. The Trustee's name and list is usually listed next to the door of each room. We will, of course, meet you in the room and take you through every thing from there, but just so you know what to expect. You will fill out a debtor information sheet, go in to the Trustee room and wait for your case to be called. The Trustee will call the docket and the cases will begin. Depending on the trustee some of the typically questions you will encounter will be. Attorneys ask questions too.
We will hand your driver's license and social security card to the Trustee's clerk.
1. Please state your name and address for the record;
2. Is it correct on your petition?
3. Do you own a home?
4. Do you own a car? Title?
5. Do you own a business?
6. Are you entitled to sue?
7. Why are you filing bankruptcy?
8. Have you ever filed bankruptcy before?
9. Are your petitions and schedules correct to the best of your information, knowlegde, and belief?
That will basically be it for the hearing.
There are some red flag issues that we prevent because we have had so many years of experience we know how to address these issues the trustee may have before the hearing.
